Water collecting laws in Oregon land a local man in jail for collecting too much rain water and water run off. He has been using the rain and run off to fill his own reservoirs on his privately owned property. Oregon officials insist that his massive water collecting efforts deny the near by city of Medford much needed use of these natural resources. Especially now in a time of temporary drought.

This situation demands that we look at the rights of individuals verses the needs of the group. Just who do natural resources belong to? Should the landowner be penalized for preparing himself and his land for drought and wildfire? Does his collection of this resource significantly effect the rights of other citizens? Is he being used as an example to prevent others from making use of natural resources that are also used by government? Did he simply carry his conservation efforts too far and over do his collecting of water? Could the city have negotiated a buy back of resources in time of need saving the city the effort of building their own additional reservoirs and providing reward to the land owner for his use of his assets? These are questions that are going to become more and more relevant as the rights of the individual and government authority collide.
